On one side, the real and/or legal person who will be referred to as the Customer in the following articles and on the other side, the address of which will be referred to as the Hotel in the following articles is Muskebi Mahallesi Eren Sk. No:12 Bodrum / Muğla / Turkey 2-B TEXTILE SAN. TUR. These parties, which will be referred to as the Parties in the following articles; Considering that this contract is an official offer, that it contains all the conditions for the provision of paid accommodation service, that all the terms stated below are binding (final) for the parties, that it is located on the website www.lugga.com.tr, that it cannot be changed by the customer, they have concluded this contract within the framework of the following.

SUBJECT OF CONTRACT

1.1. Pursuant to this Agreement, the Hotel is obliged to provide accommodation at the Hotel at the request of the Customer (hereinafter referred to as the “Service”).

1.2. By signing this contract (the Client acknowledges that he/she has signed this contract by booking accommodation at the Hotel and/or services provided by the Hotel), the Client confirms that he/she has been informed about the rules of accommodation at the Hotel, booking rules and tariffs.

1.3. From the moment this contract is concluded, the Hotel will confirm the Customer’s request.

FORM OF ACCOMMODATION RESERVATION

2.1. The reservation of the Service may be made by the Customer by calling the numbers specified on www.lugga.com.tr or by filling in the reservation form on the website www.lugga.com.tr.

2.2. In the event that the Customer wishes to make any changes to his/her request, he/she may apply to the Reservation Office of the Hotel by calling the numbers specified at www.lugga.com.tr, provided that he/she complies with the matters set out in this Agreement and fulfills the conditions.

2.3. The Customer must submit a request to change the reservation to the hotel by the Customer or a representative expressly authorized by the Customer, at least 14 days before the hotel’s estimated service delivery date (start of stay).

2.4. The customer may request a change to their reservation a maximum of once, without incurring any fees. If the customer requests more than one change, they will be charged a fee in accordance with the hotel’s change, reservation, and cancellation fees.

2.5. With this agreement, the Customer accepts, declares and undertakes that if he/she makes/wants to make changes to the reservation during the period when the special discount is applied during registration, for any reason, the new reservation will be made by taking into account the prices applied on the date the reservation change request in question was confirmed.

2.6. Free accommodation and discounts will be applied to children staying in the same villa as their parents. According to this agreement, the age of the child staying at the hotel, as specified by the Customer during the reservation process, will be taken into account during check-in. To determine the child’s age, the Customer will present the child’s ID upon check-in, if requested by the hotel staff. If the child’s ID is determined to be different from the age stated on the ID by the hotel staff, the Customer will make the necessary changes to the reservation, and the Customer will cover any resulting fee difference.

PAYMENT METHOD

3.1. The Customer will enter his/her credit card information into the system when making payments by credit card through the online reservation system.

3.2. The Hotel acknowledges that credit card information and the system through which it is submitted are protected by a special security system that prevents the information from being viewed or copied under any circumstances. Furthermore, the Hotel will not be liable for any damages resulting from third parties accessing information, documents, or secrets due to malicious programs or similar software systems originating from the Customer’s computer, or due to the Customer’s negligence, and will not be held liable in any way for such damages.

3.3. Upon check-in, the customer must present the credit card used for payment or a photocopy of the front of the credit card to the hotel staff. Any damages arising from the customer’s failure to fulfill these responsibilities will be the responsibility of the customer.

3.4. The invoice will be given to the Customer upon check-out from the hotel after receiving the service. The Hotel will not be held responsible if the invoice is not received.

3.5. Our room prices on our website are displayed in Euro/TRY/Dollar. Mail Order payments are accepted in Euro/TRY/Dollar. Information on exchange rates is provided by the Central Bank of the Republic of Turkey.

PAYMENT REFUND METHOD

4.1. The entire payment made for Standard Rate (refundable) reservations will be refunded to the Customer by the hotel within 15 business days following the cancellation or change request made by the Customer 14 days before check-in, minus the commission amount paid to the Bank.

4.2. If a cancellation or change request is made 14 days or later from the check-in date, the Customer’s accommodation fee will not be refunded, and the Customer irrevocably accepts that they have paid this amount to the hotel as a penalty. If VAT is required for any penalty or other compensation to be paid by the Customer under this agreement, the Customer is obligated to pay the applicable VAT.

4.3. Refunds or refunds made from payments made by credit card during reservation registration will be deposited by the hotel back to the bank account to which the Customer’s credit card is registered and/or the bank account to which the payment was sent.

ACCOMMODATION TYPE

5.1. The Customer’s age and identity will be checked during entry. Any expenses incurred due to incorrect information provided by the Customer will be covered by the Customer.

5.2. The Customer agrees that he/she will settle into the facility at 14:30 at the earliest on the day of check-in, regardless of the time he/she arrives at the hotel, and that he/she will check-out at 12:00 at the latest, regardless of the time he/she leaves the hotel, and that he/she will pay the cost of any additional services to be provided after leaving the villa.

5.3. The full reservation fee will be charged during online reservation.

5.4. If the Customer cancels the service after settling in at the hotel for any reason other than the Hotel’s failure to fulfill its responsibilities, the payment will not be refunded.

LIABILITY OF THE PARTIES

6.1. After the Customer settles into the property they reserved, the Hotel will be held responsible for all situations arising from reasons other than force majeure. In such cases, as per this agreement, the Hotel will compensate the Customer for any damages by refunding the Service, paying for the Service, or providing additional and/or alternative services. Acceptance of the additional service or accommodation by the Customer constitutes a waiver of the Customer’s right to claim a refund of the reservation fee and any other right to claim compensation or legal action.

6.2 Any material damage that may be caused by guests within the hotel premises shall be paid by the customer at the time of check-out.

6.3. In case of poor quality service provided to the Customer, the Customer shall notify the Hotel representative of his complaint in writing; otherwise, the service provided by the Hotel shall be deemed to have been provided flawlessly and on time.

6.4 If the Customer violates any clause of the contract, the Customer accepts and undertakes to compensate the hotel for any damages incurred as a result of the violation.

OTHER PROVISIONS

7.1. Adverse weather conditions, strikes, lockouts, terrorism, military operations, floods, fires, etc., as well as technical unforeseen circumstances, will be considered force majeure. In the event of such circumstances, the hotel may discontinue service or replace the accommodation with a similarly priced hotel in the same or another location.

7.2. The hotel reserves the right to claim compensation from you for any damage to your room, damage to public areas and/or lost items.

7.3. Young children are not allowed in the pool without their parents. Parents are responsible for their children. Villa Kırkpınar is not responsible.

7.4. Our facility has bicycles available for guest use. Our facility is not responsible for any accidents that may occur while our guests are using the bicycles.

7.5. Lugga Boutique Hotel management cannot be held responsible for any loss of money or valuables, or any accidents or injuries that may occur.
